Hello Bobby,

as Lionix pointed out, it was unfortunately not a suitable fix. That check
in the code has a reason, namely to ensure the kernel and userland agree
on data structures they pass to each other.

You would need to upgrade the kernel module instead.

I did not test myself, but 2.6 kernels should not need patching.
